StormTrap, LLC And Arrow Concrete Products, Inc. Enter Into An Agreement
Disposing of a patent litigation
Arrow Concrete Products, Inc. of Granby, Connecticut, and StormTrap, LLC of Morris, IL have entered into an agreement under confidential terms disposing of a patent litigation initiated in 2010 charging infringement of StormTrap's U.S. Patent Nos. 6,991,402 and 7,160,058 by underground storm water detention/retention systems manufactured and sold by Arrow and installed at CVS Pharmacy Store No. 843 located at 235 Center Street in Chicopee, Massachusetts in 2009, and Home Depot Store No. 9900 located at Route 111, in Trumbull, Connecticut in late 2009 to early 2010.
In this agreement, Arrow recognizes that it did not understand the full scope of StormTrap's patents and inadvertently infringed them. Arrow has agreed to turn over its profits and compensate StormTrap for the infringements. Arrow agrees to discontinue the sale of systems like those installed at the CVS and Home Depot sites. Arrow has since modified the design of its Retain-It systems, and StormTrap has agreed that several systems are "Permitted Structures" under the agreement. Arrow has agreed to a consent judgment as to the CVS and Home Depot installation.
